Filing a petition for probate is a formal request submitted to the San Diego County court, initiating the legal process of administering a deceased person’s estate. This petition essentially asks the court to appoint an executor or administrator – someone responsible for carrying out the terms outlined in the will, if there is one. It also involves submitting the original will to the court for validation and safekeeping.
The DE-111 form is the standard document used for this purpose. It details essential information about the deceased, their assets, and the nominated executor/administrator. The court reviews this petition carefully to ensure everything is in order.
Sometimes there are disagreements among family members regarding who should be appointed as executor. Consequently, the court may hold a hearing to resolve any disputes. It’s crucial for everyone involved to understand their rights and responsibilities during this process.

Certainly. I recall one instance where a family was deeply divided over who should manage the estate. Emotions ran high, and it seemed impossible to reach a consensus. Another time, a will was declared invalid because it hadn’t been properly witnessed. This unexpected development meant we had to navigate intestate succession laws – the rules that apply when someone dies without a valid will. Fortunately, we were able to guide the family through this complex process and ensure a fair distribution of assets.
