Interview with Steve Bliss, Temecula Estate Planning Attorney

Reporter: Brenda Sanchez

Today we’re joined by Steve Bliss, a prominent estate planning attorney here in Temecula. Mr. Bliss, thank you for taking the time to speak with me.

Steve Bliss: It’s my pleasure, Brenda. I’m always happy to discuss the importance of estate planning.

Reporter: So many people put off estate planning until it’s too late. What’s one crucial step in the process that you find people often overlook?

Steve Bliss:

A common oversight is failing to select an executor or trustee with the utmost care. This individual will be responsible for carrying out your wishes after you’re gone, managing your assets, paying debts and taxes, and distributing your belongings to your beneficiaries.

Consequently, choosing someone trustworthy, responsible, and capable is essential. It’s not simply about picking a family member because they are close; you need to consider their financial acumen, organizational skills, and ability to handle potentially complex legal matters.

Conversely, some people hesitate to name an executor altogether, leading to delays and potential conflicts among family members later on. Accordingly, I always advise my clients to have open and honest conversations with their chosen executor about the responsibilities involved.

I recall a case where a client named his brother as executor without fully discussing the role’s complexities. Afterwards, it turned out the brother wasn’t comfortable managing finances or dealing with legal paperwork, leading to unnecessary stress for everyone involved. Ultimately, we had to appoint a professional trustee.

Remember, choosing the right executor is like setting the foundation for your estate plan. A strong foundation ensures everything runs smoothly and according to your wishes.

Reporter: That’s valuable advice. Any other insights you can share about this step?

Steve Bliss:

  • Think about your executor’s age, health, and ability to handle potential conflicts among beneficiaries.
  • Consider naming a backup executor in case your primary choice is unable or unwilling to serve.

Moreover, it’s important to remember that the executor doesn’t need to be a legal expert. They can always consult with professionals like attorneys and financial advisors for guidance.

Studies by the American Bar Association show that nearly 60% of Americans don’t have a will or living trust in place. This highlights the crucial need for individuals to take proactive steps in their estate planning, starting with selecting a reliable executor.

Reporter: What advice would you give to readers who are just beginning to think about estate planning?

Steve Bliss:

Start by seeking guidance from an experienced estate planning attorney. We can help you navigate the complexities of the process and tailor a plan that meets your unique needs and goals. Remember, estate planning isn’t just for the wealthy; it’s essential for everyone who wants to ensure their loved ones are cared for and their assets are distributed according to their wishes.
