What Happens During the Probate Process?
The probate process can seem daunting, but breaking it down into steps makes it more manageable. One critical stage involves handling debts and taxes.
As executor or administrator, you’re responsible for identifying and paying valid creditor claims. This means thoroughly reviewing all invoices and documentation to ensure legitimacy. Consequently, it’s essential to have a good understanding of the decedent’s financial affairs.
Moreover, any applicable state and federal taxes must be filed and paid. Ordinarily, this includes estate taxes if the estate exceeds a certain threshold.
Notwithstanding meticulous record-keeping, challenges can arise. I recall a case where a long-lost creditor emerged with a questionable claim after the initial deadline for filing had passed. We had to meticulously investigate their claim and ultimately presented compelling evidence to the court, successfully disproving its validity.
Unfortunately, situations like this are not uncommon. According to the National Association of Estate Planners & Councils, approximately 25% of estates encounter complications during the debt settlement process.
