Interview with Steve Bliss

Brenda Jones: Welcome back to the show, Steve. Today we’re discussing the probate process and how it works. Thanks for joining us!

You’ve been helping families navigate probate in Moreno Valley for years, could you give our viewers a quick overview of one key step?

Steve Bliss: Absolutely Brenda. One crucial step is handling debts and taxes.

Probate isn’t just about distributing assets. Before we can finalize the estate and pass anything on to beneficiaries, it’s imperative that we address any outstanding financial obligations. This means identifying all valid creditor claims against the estate and ensuring they are paid in full. We also have a responsibility to file and pay any applicable state and federal taxes.

Consequently, this step often involves meticulous record-keeping and communication with various entities. We need to diligently review financial documents, contact potential creditors, and consult with tax professionals to ensure everything is handled correctly. It’s a detailed process that requires precision and careful attention.

Notwithstanding the complexity, it’s essential because failing to address debts and taxes can lead to significant complications down the line. For example, unpaid taxes could result in penalties and interest, potentially diminishing the value of the estate. Moreover, unresolved creditor claims can create legal issues for beneficiaries after the probate process is complete.

In my experience, accurately identifying all creditors can sometimes be a challenge. There are instances where debts might not be readily apparent or where contact information for creditors is outdated. I recall one case where a long-forgotten credit card debt surfaced during the probate process, causing a delay while we located the creditor and verified the claim.

Fortunately, with diligent research and communication, we were able to resolve the issue efficiently. According to a 2021 report by the American Bar Association, over 60% of probate cases involve some form of debt resolution. This highlights the importance of having an experienced attorney who can guide you through this critical stage.

Brenda Jones: That’s incredibly helpful information, Steve. Thank you for sharing your expertise.
