Notwithstanding these careful considerations, unforeseen circumstances can arise. I once had a client who initially chose their eldest child as executor, only to discover later that this individual was struggling with financial difficulties. We ultimately had to work together to find a more suitable alternative, which caused some understandable stress for the family.
Conversely, I’ve also witnessed heartwarming instances where executors went above and beyond to ensure the smooth distribution of assets according to their loved one’s wishes.
