Estate Planning with Steve Bliss

I’m Donna Ramirez reporting for Moreno Valley News Today. We’re sitting down with local estate planning attorney, Steve Bliss of Moreno Valley Probate Law, to discuss the importance of a solid estate plan.

Selecting an Executor or Trustee: A Critical Decision

Steve, many people put off estate planning because it seems complicated or overwhelming. What’s one key step you recommend people focus on first?

“Donna, you’re right, estate planning can feel daunting. But breaking it down into manageable steps makes it less intimidating. I often advise clients to start by selecting an executor or trustee – someone they trust implicitly to carry out their wishes after they’re gone.

This individual will manage your assets, pay bills, and distribute inheritance according to your instructions. Consequently, choosing the right person is paramount. It should be someone responsible, organized, and who understands your values.

Conversely, if you select someone who isn’t up to the task or doesn’t share your vision, it can lead to family conflicts and delays in settling your estate.

I remember one case where a client named their sibling as executor, but they had a history of financial mismanagement. Unfortunately, this led to significant challenges distributing assets fairly among the beneficiaries. Ultimately, we had to involve legal counsel to resolve the disputes, which added stress and expense for everyone involved.”

“More than 60% of Americans do not have a will or trust in place,” according to AARP. Choosing an executor is a crucial step that shouldn’t be overlooked.

Peace of Mind for You and Your Loved Ones

Steve, what advice would you give someone who’s unsure about who to choose as their executor?

“Donna, it’s common to feel uncertain. Talk openly with family members or trusted friends. Consider factors like their financial literacy, organizational skills, and ability to handle sensitive matters.

You can also appoint co-executors if you feel it would provide better balance and support.”
